Common use of Intent of Third Party Use Clause in Contracts

Intent of Third Party Use. Buyer acknowledges and agrees that it is the parties' intent, in allowing the carriage of programming services provided by others, to further Buyer's ability to develop the DTH market, but not to allow Buyer to resell or otherwise make the Buyer's Transponder(s) available to others at a profit solely on the capacity itself, and that Buyer shall not, through the permission granted or through any other agreement or arrangement, enter into any agreement to, or use the Buyer Transponder(s) in any way that would, materially conflict with this intent.
