Common use of INTERFERENCE WITH EQUIPMENT Clause in Contracts

INTERFERENCE WITH EQUIPMENT. Each Party shall ensure that its agents, employees and invitees do not interfere in any way with the other Party’s Plant, Equipment or Apparatus (including, without limitation, Metering Equipment) without the consent of the other Party, except where emergency action has to be taken to protect the health and safety of persons or to prevent damage to property proximate to the relevant asset or to preserve or protect the Distribution System, in which case interference in order to protect the health and safety of such persons or to prevent such damage to property or to preserve or protect the Distribution System shall be allowed.
