Interim Obligations upon a Finding of Unforeseen Circumstances. If the Service makes a finding of Unforeseen Circumstances, during the period necessary to determine the nature and location of additional or modified mitigation, NiSource will avoid undertaking any action that appreciably reduces the likelihood of the survival and recovery of any Take Species in the Covered Lands.
