Common use of Interpretation and Enforcement Clause in Contracts

Interpretation and Enforcement. 1. The Parties shall take all appropriate measures, whether general or particular, to ensure fulfilment of the obligations arising out of this Agreement and shall refrain from any measures which would jeopardise attainment of the objectives of this Agreement. 2. Each Party shall be responsible, in its own territory, for the proper enforcement of this Agreement. 3. Each Party shall give the other Party all necessary information and assistance subject to the applicable laws and regulations of the respective Party, in the case of investigations on possible infringements which that other Party carries out under its respective competences as provided in this Agreement. 4. Whenever the Parties act under the powers granted to them by this Agreement on matters which are of interest to the other Party and which concern the competent authorities or undertakings of the other Party, the competent authorities of the other Party shall be fully informed and given the opportunity to comment before a final decision is taken. 5. Insofar as the provisions of this Agreement and the provisions of the acts specified in Annex II to this Agreement are identical in substance to corresponding rules of the EU Treaties and to acts adopted pursuant to the EU Treaties, those provisions shall, in their implementation and application, be interpreted in conformity with the relevant rulings and decisions of the Court of Justice and the European Commission.
