Common use of Interpretation and Usage Clause in Contracts

Interpretation and Usage. As used in this Agreement, unless otherwise specified, (a) all references to Sections, Articles, Schedules or Exhibits are to Sections, Articles, Schedules or Exhibits of or to this Agreement, (b) the terms “include” and “including” and similar words or phrases are to be construed as if followed by the phrase “without limitation”, regardless whether such phrase actually appears, (c) the terms “herein”, “hereinafter”, “hereto”, “hereby” and “hereunder”, when used with reference to this Agreement, refer to this Agreement as a whole, unless the context otherwise requires, (d) any pronoun shall include the corresponding masculine, feminine and neuter forms, (e) the singular form of nouns, pronouns and verbs shall include the plural and vice versa, and (f) unless otherwise determined by the General Partner, all monetary transactions between the Partners and the Partnership, including Capital Contributions and distributions, shall be effected in U.S. Dollars. The table of contents and the headings of the articles, sections and subsections of this Agreement are inserted for convenience of reference only and shall not be deemed to constitute a part hereof or affect the interpretation hereof.
