Common use of Interpreter Clause in Contracts

Interpreter. The Professional is, in the first instance, the interpreter of the construction Contract Documents and the initial evaluator of the construction contractor's performance. Within seven days or less when the situation requires, after receipt of a written request from the Department or a construction contractor when directed by the Department, the Professional shall render in writing an interpretation or evaluation consistent with the Contract Documents. When necessary to adequately clarify and resolve a request, the Professional shall prepare and distribute supplemental drawings and Specifications that further describe or explain the content of the Contract Documents. The Professional shall provide the Department with a copy of any interpretation for distribution to the construction contractor. Interpretation of Contract Documents and response to construction questions, including the preparation and distribution of supplemental drawings and Specifications required to provide satisfactory clarification, is considered part of Basic Services and the Professional shall not make a claim for additional compensation.
