Common use of Intervention by Trustee Clause in Contracts

Intervention by Trustee. In any judicial proceeding to which the Agency or the City is a party that, in the opinion of the Trustee and its counsel, has a substantial bearing on the interests of Owners of any of the Bonds, the Trustee may intervene on behalf of such Bond Owners, and subject to Section 6.02(c), shall do so if requested in writing by the Owners of at least 25% in aggregate principal amount of such Bonds then Outstanding.

Intervention by Trustee. In any judicial proceeding to which the Agency or the City is a party that, and which in the opinion reasonable judgment of the Trustee and its counsel, counsel has a substantial bearing on the interests of Owners of any holders of the Bonds, the Trustee may intervene on behalf of such Bond OwnersBondholders and, and subject to the provisions of Section 6.02(c8.1(k), shall do so if requested in writing by the Owners Requisite Bondholders. The rights and obligations of at least 25% in aggregate principal amount the Trustee under this Section are subject to the approval of such Bonds then Outstandinga court of competent jurisdiction.

Intervention by Trustee. In any judicial proceeding to in which the Agency or the City is a party thatand which, in the reasonable opinion of the Trustee and its counsel, has a substantial material bearing on the interests of the Owners, the Trustee, if permitted by the court having jurisdiction over such proceeding, may, in its discretion, or, upon the written request of Owners of any not less than a majority in principal amount of the BondsBonds then Outstanding, and upon being indemnified to the Trustee may satisfaction of the Trustee, shall intervene on behalf of such Bond Owners, and subject to Section 6.02(c), shall do so if requested in writing by the Owners to assert the rights of at least 25% in aggregate principal amount of such Bonds then Outstandingthe Owners.

In any judicial proceeding to which the Agency Authority or the City is a party that, in the opinion of the Trustee and its counsel, has a substantial bearing on the interests of Owners of any of the Bonds, the Trustee may intervene on behalf of such Bond Owners, and subject to Section 6.02(c), shall do so if requested in writing by the Owners of at least 25% 25 percent in aggregate principal amount of such Bonds then Outstanding.
