Common use of Investigation and Defense Clause in Contracts

Investigation and Defense. Except as provided in Article XVI Section 2 above, the Administrator will investigate, or cause to be investigated, all such claims referred to in the foregoing paragraphs and will attempt to adjust or settle such claims, in accordance with the authority delegated to the Administrator by the BETA Council and the Member involved. Each party to this Agreement hereby delegates such authority, subject only to the terms and conditions of the Group Self-Insurance Programs in which the Member participates. As required by, and subject to, the provisions of the Coverage Contracts, BETARMA, through designated defense counsel, will provide legal defense of claims against Members. The Member agrees to cooperate fully with BETARMA in such matters and to provide and make available all information and personnel as may be reasonably required in the opinion of Administrator to fully investigate and defend the claim.
