IS THE RECORD Sample Clauses

The "IS THE RECORD" clause serves to establish which documents or records are considered the definitive and authoritative source of information for a particular agreement or transaction. In practice, this clause specifies that only certain records—such as signed contracts, official correspondence, or designated databases—will be recognized as valid evidence of the parties' rights and obligations. By clearly identifying the official record, this clause helps prevent disputes over which documents are binding, ensuring clarity and reducing the risk of misunderstandings.

Historical personal information may only be disclosed where authorised or required by New Zealand law. 5.4 To the extent GDPR applies, EU registrants have the right to object to the registry storing historical personal information and/or disclosing it as authorised or required by New Zealand law. 5.5 Despite clause 5.4, pursuant to Article 21 of GDPR, the registry maintains that it has compelling legitimate grounds for storing an historical auditable record of all domain names and disclosing historical personal information as authorised or required by New Zealand law. This is because without carrying out these functions, the integrity and operation of the register would be significantly undermined.
