Common use of Issuance of Additional Shares Clause in Contracts

Issuance of Additional Shares. The Sponsor shall have authority to authorize the issuance, from time to time, of authorized but unissued Shares and cause the Trust to issue such additional Shares in exchange for and upon receipt of an equal number of Sponsor Interests. Upon the issuance of such additional Shares, one of the Regular Trustees shall execute in accordance with Section 4.2 one or more Share Certificates in certificated, fully registered form and shall deliver such Share Certificates to the Transfer Agent. The Trust may issue the Shares, in one or more series, in any manner, subject to applicable law, that the Sponsor, acting through its Board of Directors, in its sole discretion, deems appropriate and advisable.

The Trust Sponsor may issue sell or distribute the Shares, in one or more series, Shares in any manner, subject to applicable law, that the Sponsor, acting through its Board of Directors, Directors in its sole discretion, discretion deems appropriate and advisable.
