ISSUANCE OF BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY. The Developer may obtain building permits and certificates of occupancy within Manor Commercial Park (the “Subdivision”) prior to completion of the City Wastewater Improvements, subject to full compliance with the following terms and conditions: (a) The facilities necessary to provide Pump and Haul service to the lot for which a building permit or a certificate of occupancy is to be issued have been completed and passed inspection by the City, and wastewater service by Pump and Haul under this Agreement is otherwise available to the Property. (b) Developer is in compliance with the terms and conditions of this Agreement. (c) ▇▇▇▇▇▇▇▇▇ demonstrates to the City that the Developer has a current contract with a Pump and Haul provider that meets the requirements of this Agreement. (d) All other conditions for issuance of a building permit or certificate of occupancy set forth in applicable local (as modified by this Agreement), state, or federal regulations have been met.
ISSUANCE OF BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY. 6.8.1 Where a surety instrument has been required for a subdivision, or any section of a subdivision, no certificate of occupancy for any building in the subdivision or section thereof shall be issued prior to the approval of construction plans and completion and dedication of the improvements to the appropriate governmental unit, as required in the Planning Commission’s resolution of final approval of the subdivision plat. The extent of public way improvements shall be adequate for vehicular access by the prospective occupant and by police and fire equipment prior to the issuance of an occupancy certificate. The subdivider/developer shall submit money in escrow to the Planning Commission in a sum determined by the appropriate governmental representative. 6.8.2 All driveway culverts shall be installed by the builder according to the design criteria and approved by the Department of Public Works before the building inspector issues a certificate of occupancy.

  • Certificates of Occupancy To the extent the same are in Seller’s possession, original or photocopies of certificates of occupancy for all space within the Improvements located on the Property;

  • Certificate of Occupancy The Contractor’s obligation under the Contract is to install the Work in accordance with the Contract Documents, obtain the Certificate of Occupancy from the State Fire Marshal or his deputy, and forward it to the Design Professional as a part of the final close out procedures. The Design Professional’s obligation is to design the Work to comply with the applicable codes and to qualify for a Certificate of Occupancy.

  • Building Permits All building permits required for the construction of the Improvements have been obtained prior to the commencement of the construction of the Improvements and copies of same will be delivered to Lessor.

  • Certificate of Occupancy; Licenses All certifications, permits, franchises, licenses, consents, authorizations, and approvals, including, certificates of completion and occupancy permits, required for the legal use, occupancy and operation of the Property have been obtained and are in full force and effect. The use being made of the Property is in conformity with the certificate of occupancy issued for the Property.

  • Building Permit The Owner shall pay for all permits. The Owner and AE shall be required to provide such information to the Permitting Authority as is necessary to obtain approval from the Permitting Authority to commence construction prior to beginning construction. The CM shall pull the Building Permit, and shall be responsible for delivering and posting the Building Permit at the Project Site prior to the commencement of construction. The Owner and AE shall fully cooperate with the CM when and where necessary.
