Common use of Issuance of New Warrant Certificates Clause in Contracts

Issuance of New Warrant Certificates. Whenever the Company is required to issue a new Warrant Certificate pursuant to the terms of this Warrant Certificate, such new Warrant Certificate (i) shall be of like tenor with this Warrant Certificate, (ii) shall represent, as indicated on the face of such new Warrant Certificate, the number of unexercised Warrants then underlying this Warrant Certificate (and in the case of a new Warrant Certificate being issued pursuant to Section 7(b), the number of Warrants designated by the Holder which, when added to the number of Warrants represented by the other new Warrant Certificates issued in connection with such issuance, does not exceed the number of unexercised Warrants then represented by this Warrant Certificate), (iii) shall have an issuance date, as indicated on the face of such new Warrant Certificate which is the same as the Issuance Date, and (iv) shall have the same rights and conditions as this Warrant Certificate.

Whenever the Company is required to issue a new Warrant Certificate pursuant to the terms of this Warrant CertificateAgreement, such new Warrant Certificate (i) shall be of like tenor with this the applicable Warrant Certificate, (ii) shall represent, as indicated on the face of such new Warrant Certificate, the number of unexercised Warrants then underlying this such Warrant Certificate (and or in the case of a new Warrant Certificate being issued pursuant to Section 7(b9(a) or Section 9(c), the number of Warrants designated by the Holder which, when added to the number of Warrants represented by underlying the other new Warrant Certificates issued in connection with such issuance, does not exceed the number of unexercised Warrants then represented by this underlying the applicable Warrant Certificate), (iii) shall have an issuance date, as indicated on the face of such new Warrant Certificate which is the same as the Issuance Date, and (iv) shall have the same rights and conditions as this the applicable Warrant Certificate.
