Common use of Issue of Certificate of Making Good Clause in Contracts

Issue of Certificate of Making Good. The Landlord shall use reasonable endeavours to procure that the Contract Administrator: gives at least five (5) working days' notice to the Tenant of the Contract Administrator's intention to inspect the Landlord's Works for the purpose of issuing a Certificate of Making Good and allows the Tenant and the Tenant's surveyor to attend the inspection and make representations either during the inspection or in writing immediately thereafter; and without fettering the discretion of the Contract Administrator in carrying out duties under the relevant Building Contract, takes proper account of any representations that are made in accordance with clause 6.6.1 when considering whether to issue a Certificate of Making Good in accordance with the terms of the relevant Building Contract. The Landlord shall procure that the Contract Administrator gives a copy of any Certificate of Making Good to the Tenant as soon as practicable after its issue. The Tenant will use its best endeavours to provide collateral warranties in favour of TDC where these are available in respect of Tenant's Works.
