Item 5. Nothing in this Agreement shall limit the City in the exercise of its function of management and in the direction and supervision of the City's business. This includes, but is not limited to the right to: add or eliminate departments; require and assign overtime; increase or decrease the number of jobs; change process; assign work and work to be performed; schedule shifts and hours to work and lunch or break periods in unexpected circumstances; hire, suspend, demote, discipline, or discharge; transfer or promote; layoff because of lack of work or other legitimate reasons; establish rules, regulations, job descriptions, policies and procedures; conduct orderly operations; establish new jobs; abolish and change existing jobs; determine where, when, how and by whom work will be done; determine standards of proficiency in police skills and physical fitness standards; except where any such rights are specifically modified or abridged by terms of this Agreement. Unless an express, specific provision of this Agreement clearly provides otherwise, the City, acting through its Mayor, City Council and Police Chief or any other appropriate officials as may be authorized to act on their behalf, retains all the rights and prerogatives it had prior to the signing of this Agreement either by Law, custom, practice, usage or precedent to manage and control the Police Department. By way of example but not limitation, management retains the following rights:
Item 5. Venue 5.1. The exhibition will be displayed at: venue. 5.2. The exhibition, and access to the venue where it is displayed, must be accessible to the public free of charge.
Item 5. Except to the extent that there is contained in this Agreement an express and specified provision to the contrary, the City retains, whether exercised or not, all of the authority, power, rights, jurisdiction, and responsibility provided by the Laws of the Commonwealth of Massachusetts to such City for the control, direction and management of the City and its work force, including but not limited to: The right to manage the affairs of the City and the Department and to maintain and improve the efficiency of its operation; to determine the methods, means, processes and personnel by which operations are to be conducted; to determine and schedule hours of duty consistent with the statutes and ordinances and collective bargaining agreement of the City and the assignment of bargaining unit employees to work; to require from each bargaining unit employee the efficient utilization of his/her service; to hire, promote, assign and retain bargaining unit employees; and to promulgate and support rules and regulations pertaining to the operations of the Dispatch Unit and to the bargaining unit employees. The City shall not exercise such rights in derogation of the collective bargaining law or the terms of this Agreement.
Item 5. Choice vacation leave shall be scheduled between May 1st and September 30th and shall include the weeks of Thanksgiving and Christmas.
Item 5. Item 5 of the Summary of Basic Terms of the Lease is deleted in its entirety and replaced with the following: "5. Lease Term: From March 1, 2014 through February 29, 2020."
Item 5. The Second Party undertakes to do the periodic maintenance of the leased premises in order to preserve it and to keep it in the state as was first examined and received by contracting with excellent-class specialized companies or the agents of the installed devices including but not limited to Electrical, boards, Electronic devices, Circuit breakers, Ventilation. البند السادس:ـ 1- لا يحق للطرف الأول التدخل في أي تصميم أو تعديل داخل العين المؤجرة مالم يضر بسلامة المبنى ويكون الطرف الثاني مسئول عن المخالفات أمام الجهات الرسمية ولا يحق للمؤجر الإشراف أو طلب أي مواصفات معينه تخص الطرف الثاني . 2- يلتزم الطرف الثاني بالمحافظة علي نظافة وسلامة العين المؤجرة كما يلتزم بقرارات إدارة العين المؤجرة المتعلقة بالصيانة والنظافة والأمن والسلامة .وإدارتها بالشكل الذي يحافظ على سلامتها وسمعتها. 3- يلتزم الطرف الثاني بان يضع النفايات في ألأوعية في الأماكن المخصصة وعدم تجميعها في الساحات ألعامه. 4- يتعهد الطرف الثاني بعدم وضع أي إعلان أو لافتات ألا في الأماكن المخصصة للإعلانات وبعد الموافقة الخطية من المؤجر. 5- يتعهد الطرف الثاني المستأجر بعمل الصيانة الدورية للعين المؤجرة بما يكفل المحافظة عليها وإبقائها بالحالة التي استلمها بها وذلك بالتعاقد مع وكلاء الأجهزة التي تم تركيبها أو شركات متخصصة من الدرجة الممتازة . وهي علي سبيل المثال لا الحصر: *اللوحات الكهربائية * الأجهزة الالكترونية *القواطع الكهربائية* التهوية .

Item 5. The Lessor (the First Party) shall not be liable of any kind whatsoever if the leased premises is exposed to fire, fraud, burglary or theft. The lessee and the Lessor must conduct all necessary precautions. And the Lessee shall be liable for damages caused to the Lessor or third parties due to the Lessee’s negligence. Article 11: Item 6: The Lessor shall not be bound by liability for any damages or harms resulting from causes beyond his control such as earthquakes, fire, floods or any actions or behavior, whether originating from individuals, groups or force majeure. The Second Party shall undertake immediate measures, precautions and repairs without delay against these sudden damages.
