Job Preference. Section 1. An open position shall be defined as a position covered by this Agreement in a wage classification that requires additional personnel. When the Center determines that open positions are to be filled other than on a temporary basis, the open positions shall be filled as provided for in this Article. Section 2. The Center recognizes the right of seniority employees, in line with their Regional Mental Health Center wide seniority to seek work in another wage classification. Openings in wage classifications for positions covered by this Agreement shall be filled in the following manner: A. The Center shall post a notice on the bulletin board at each facility when a vacancy is to be filled. This notice shall state the salary range for the position. The notice shall remain posted for not less than five (5) working days. B. Employees of the Center who have completed 6 months of service may bid for said vacancy by signing said notice. In the event no bid by a qualified employee with over 6 months’ seniority is submitted, the Center may transfer employees with less than 6 months’ seniority to said vacant position or hire from the outside to fill said position as the Center deems appropriate. Employees with less than 6 months’ seniority may submit a Preference Application to show an interest in being considered for such position. Before hiring from the outside the Center will consider all such Preference Applications filed but the decision of the Center will be final. (i) Employees shall be able to bid for a position in any other wage classification. (ii) Where there is a vacancy in a wage classification, an examination of all bids to said wage classification shall be made. If a qualified (which includes experience with targeted population and/or transferable skills, as reasonably determined by the Center and not being under a corrective action plan) employee has bid the vacancy, the employee shall be assigned the vacant position. If more than one (1) such qualified employee bids the vacancy, the bid of the qualified employee with the greatest seniority shall be accepted. If no qualified employee bids the job, the Center shall have the right to hire a qualified employee or to fill said job from among those remaining employees who have bid for said job. In so doing the Center shall review the abilities, attitude, educational achievements and experience of those interested. The Center shall select the person it deems to be the candidate and so award the job. (iii) Employees awarded an open position as provided for above shall not have the right to register for another job transfer pursuant to this Job Preference Article for a period of twelve (12) months thereafter. Section 3. The Center agrees that when an employee moves to a job in a higher wage grade by virtue of filling a vacancy in accordance with the terms of this Article, the Center will give to the employee filling the vacancy a reasonable time (not to exceed ninety [90] days) to satisfactorily perform said job. In the event that the employee is not able to show satisfactory progress toward attaining said proficiency or is not able to achieve such within a reasonable period of time, the employee will be returned to the position that said employee held prior to accepting said job preference offer. If the employee is so returned, such employee will not be eligible to bid again for twelve (12) months. Section 4. The Center agrees that in the event it creates new wage classifications it will give written notice of said new classifications, including a description of the job, to the Union no less than five (5) workdays prior to the filling of vacancies in said wage classifications.

Job Preference. Section 1. An open position shall 1 - Press Department (a) One week following the shift preference change in Article XVII, Section 3, the Punch Press Operators in the Punch Press Department will be defined as a position covered permitted to select by this Agreement seniority the press group in a wage classification that requires additional personnel. When the Center determines that open positions which they are to operate until the next shift preference (if no shift preference procedure is required, then job preference will be filled posted on each June 1). All preference jobs will be posted whether they are running or not. Any operators failing to select will be considered floaters. (b) Whenever one of these assigned personnel relinquish or vacate a selected press group, the most senior floater wishing to select the vacated press group will be so assigned until the next selection period. (c) When a press group is not operating, the assigned operator will select his job preference of any opening by seniority where practical. In the event of absenteeism is of such an extent, and employees on preferred jobs are needed to operate other than machines, they can be assigned to fill vacancies, but only if their preferred presses do not operate on their shift during such assignments. (d) Whenever a job is functioning, or two or more press groups are producing the same product and for some reason one press group does not operate, the senior employee or employees will continue to work at remaining machine or machines with the least senior employee becoming a floater. (e) If a preferred assignment employee requests to be placed in the floater group, he will become the lowest seniority floater for press assignments until thirty calendar days have elapsed and during this thirty-day period, he cannot bid on a temporary basispreferred job. (f) Within the press group assignment, the open positions shall be filled as provided for in this Articlesupervisor may assign personnel without regard to seniority. Section 2. If a permanent vacancy or a new job occurs in the bargaining unit and if the Board determines to fill such position, the position shall be defined as a position covered by this Agreement in a wage classification that requires additional personnel. The Center recognizes the right of seniority employees, in line with their Regional Mental Health Center wide seniority to seek work in another wage classification. Openings in wage classifications for positions covered by this Agreement shall be filled in the following manner: A. The Center shall post a notice posted on the bulletin board at each facility when for a vacancy is to be filled. This notice shall state the salary range for the position. The notice shall remain posted for not less than period of five (5) working daysdays during which period, seniority employees may make a written application for such job to the department supervisor. The posting notice will contain location and shift. Notice of applications from members of the bargaining unit shall be furnished to the Local President. Employees failing to submit a written application within the five (5) working day posting period shall be considered as having refused to apply for such vacancy. Prior to leaving on vacation, an employee must notify the Director of Maintenance in writing with a copy to the Superintendent, or his designee, of their interest in receiving any job postings and a phone number where they can be reached. The District shall be responsible for notifying members of job postings during any other absences covered under the contract. B. Employees b. Such vacancy shall be filled on the basis of applicants meeting minimum ability and job experience requirements and when these are equal, seniority shall prevail. The Center agrees that when an employee moves to a job in a higher wage grade by virtue of filling a vacancy lower classification in accordance with the terms seniority provisions of this Articlecontract.
