Meetings will take place during the regular teacher workday, and substitutes shall meet as neededbe provided to release bargaining unit members from their regular duties.
3. The Joint Panel shall be responsible for the following:

b. Establish its own rules of procedure, including the method for the selection of a Chairperson by an affirmative vote. In addition, the Panel is responsible for: ● submitting to the Board of Trustees and the Association an annual evaluation of the Program's impact, including but not limited torecommendations regarding Participating Unit MembersTeachers with unsatisfactory evaluations, identifying Referred Teachers who and, if necessary, forwarding names of individuals who, after sustained assistance, are unable to demonstrate satisfactory improvement after sustained assistance. Initially, and SCCEA shall select two (2) classroom Unit Member permanent teachers: one each from Alternative Education and Special Education, and one certificated staff member from DIS (Itinerant). SCCEA has determined the following qualifications for the panel participants:
1.1.1 must be SCCEA members.
1.1.2 must have achieved permanent status.
1.1.3 may volunteer or be nominated by SCCEA.
1.1.4 Each department/group will elect their own Panel member with a simple majority.
1.2 Panel members agree to serve a one-year term. SCCEA members of the Panel shall serve for three receive $1,000 and the necessary training to perform their duties. The full Panel shall meet at times and places as they shall determine, no less than four times annually. Meetings will be scheduled so as not to interfere with contact time with students. Teachers who are members of the Joint Committee shall be released from their regular duties to attend meetings, without a loss of pay or benefits.
1.3 The responsibilities of the Joint Panel shall include the following:

1.3.6 No later than May 7, the Joint Panel will be informed of an unsatisfactory evaluation and within thirty days will assign a Consulting Teacher.
1.3.7 Send written notification to the Board regarding Referred Teachershome of the voluntary or referred participating teachers, including but not limited to, identifying Referred Teachers who are unable to demonstrate satisfactory improvement after sustained assistance. Only the Panel’s written recommendation shall be made available for placement consulting teacher and administrator of participation in the Referred Unit Member’s personnel file. A copy of the recommendations shall be given to the Referred Participating Unit Member at the same time it is given to the Board; and
f. Evaluate annually the impact of the PAR program in order to improve the program.

5.1.6 coordinating with the District to provide training for Consulting /Mentor Teachers, for Panel Members, and where appropriate, for Participating Teachers;
5.1.7 forwarding to the Personnel Office at the end of the year all the records regarding the Program that shall be filed separately from the individual personnel records, except the final evaluation of a teacher's participation in the program shall be made available for placement in the Referred Unit Member’s personnel file. A copy file of the recommendations shall be given to the Referred Participating Unit Member at the same time it is given to the Board; and
f. Evaluate annually the impact of the PAR program in order to improve the programreferred teacher receiving assistance.
4. All proceedings and materials related to evaluations, reports and all personnel matters shall be strictly confidential. Therefore, Joint Panel members and Support Providers may disclose such information only as necessary to administer this article. Each member shall annually sign a confidentiality statement.
5. Joint Panel Unit Member members shall be provided reasonable release time for training regarding their duties and observations of Support Provider applicants. If in- service training or meetings take place outside of work hours, these Unit Members shall be compensated at the contractual rate.

4) A minimum of five (5) years of recent and successful classroom teaching experience
e. The Panel will be chaired in the first year by a Teacher Representative, and in the following year by a member selected by the District. The chair will thereafter rotate on an annual basis between Association and District members.
f. Although the Panel will determine its own meeting schedule, it shall schedule a meeting at least once each trimester. Five of the seven Panel members will participate in training to understand PAR constitute a quorum for purposes of meeting and BTSA program as well as formative assessment, not to exceed one day of training.

h. The Joint Panel may establish internal operating procedures as well as any guidelines necessary to implement the provisions of this Article. Said guidelines or procedures shall be consistent with the provisions of this Agreement and the law.
i. The Panel shall be responsible for the following:
a. Adopt Rules 1) Selecting and Procedures assigning Consulting Teachers.
a) Establishing the selection process including application processing, observing, and interviewing
b) Determining and posting the number/descriptions of Consulting Teachers positions that will be needed
c) Interviewing, observing, selecting, and assigning Consulting Teachers
2) Notifying the Consulting Teacher, Participating Teacher, Principal, and Assistant Superintendent of Personnel Services of the assignment of the Consulting Teacher to effect the provisions Participating Teacher. The Consulting Teacher and/or Participating Teacher shall have the opportunity to petition the Panel for an assignment change.
3) Monitoring the Consulting Teachers, and reviewing their reports on the progress of the Participating Teachers.
4) Communicating with the Participating Teacher to determine the Program’s effectiveness.
5) Encouraging a cooperative relationship between the Consulting Teacher and the Principal.
6) Coordinating with the Assistant Superintendent of Educational Support Services to provide program training as necessary to Consulting Teachers, Participating Teachers, and Panel members.
7) Reviewing the final reports made by the Consulting Teachers and submitting to the Governing Board an annual assessment of the Program’s impact, including forwarding the names of individuals who did not make satisfactory progress. The report will include:
a) A brief description/narrative of the PAR Program. Said Rules Program and Procedures will be consistent with its impact
b) The number of teachers participating in the provisions of this Agreement, program and to the extent there is an inconsistency, the Agreement will prevail;
b. Receive necessary training to implement the PAR and BTSA Programs;
c. Select PAR and BTSA Support Providers by June 1 whether or not it was successful for the following yearparticipants
c) A confidential list of names of individuals who, depending upon need;
d. The selection process for Support Providers shall include a classroom observation of candidates;

19.3.3 The Joint Panel shall:
a. administer the Peer Assistance and Review Program,
b. establish its rules and procedures,
c. develop program budget subject to Governing Board approval,
d. Panel members will participate determine the number of Consulting Teachers in any one year, guided by and subject to such factors as the number and types of Mandatory and Voluntary Teachers and available funds,
e. select Consulting Teachers,
f. provide training to understand panel members,
g. provide training to Consulting Teachers,
h. provide a list of available Consulting Teachers,
i. receive referrals, notify in writing Participating Teacher, supervising administrator, and Consulting Teacher,
j. receive and accept/reject requests from Voluntary Participants and assign Consulting Teachers based on availability of Consulting Teachers,
k. receive copies of improvement plans,
l. receive and review Consulting Teacher reports and make available to the supervising administrator,
m. create a report which includes recommendations to the Governing Board on Mandatory Participants regarding continuance in PAR, n. evaluate Consulting Teachers annually regarding performance in PAR,
o. make recommendations regarding the continuation of Consulting Teachers for the next year of the term,
p. review PAR program annually and BTSA program as well as formative assessment, not report to exceed one day of trainingthe Governing Board and to the Association.
219.3.4 Decisions of the panel shall be made by consensus whenever possible. In the event that consensus cannot be reached, action may be taken on an affirmative vote of at least five (5) members.
19.3.5 The Joint Panel shall meet as needednot act on a Consulting Teacher’s report before ten (10) workdays following receipt of the report to allow a participating teacher to submit a written response. By written agreement of the Joint Panel and the participating teacher, timelines may be extended.
3. The 19.3.6 Any member of the Joint Panel shall be responsible for the following:
a. Adopt Rules refrain from participation in discussion and Procedures to effect the provisions voting on any matter in which he or she has a professional or personal conflict of the PAR Program. Said Rules and Procedures will be consistent with the provisions of this Agreement, and to the extent there is an inconsistency, the Agreement will prevail;

c. Select PAR and BTSA Support Providers by June 1 for the following year, depending upon need;
d. The selection process for Support Providers shall include a classroom observation of candidates;
e. The Joint Panel shall review peer review reports prepared by Consulting Teachers and make recommendations to the Board regarding Referred Teachers, including but not limited to, identifying Referred Teachers who are unable to demonstrate satisfactory improvement after sustained assistance. Only the Panel’s written recommendation shall be made available for placement in the Referred Unit Member’s personnel file. A copy of the recommendations shall be given to the Referred Participating Unit Member at the same time it is given to the Board; and
f. Evaluate annually the impact of the PAR program in order to improve the programinterest.
4. 19.3.7 All proceedings and materials related to evaluations, reports and all other personnel matters shall be strictly confidential. Therefore, The Joint Panel members members, Consulting Teachers and Support Providers supervising administrators may disclose such information only as necessary to administer this article. Each member shall annually sign a confidentiality statementarticle or otherwise as required by lawful process.
5. 19.3.8 All rules and procedures established by the Joint Panel Unit Member members shall be provided reasonable release time for training regarding furnished upon request.
19.3.9 The District shall defend and hold harmless individual panel members from any claims or lawsuits arising out of the performance of their duties and observations of Support Provider applicants. If in- service training or meetings take place outside of work hours, these Unit Members shall be compensated at the contractual rateunder this program.
