Layoff Procedure. a) In the event that a reduction of the work force in any of the Employer’s Divisions is required, the Employer agrees to adjust its workforce and layoff separately full-time and part-time Employees in the following order, subject to the provisions of (b) below: 1. The Employee(s) with the least amount of seniority in the Division affected, will be displaced from the Division in sufficient number so as to provide for the required work force adjustment in the Division, and 2. An Employee displaced from a Division in accordance with (1) above will be considered for employment in some other Division of the Employer. Any resultant layoff will occur on the basis of seniority with the Employer. b) This displacement and/or layoff of an Employee will only occur on the basis that the senior Employee who retains employment is qualified and able to perform the work available. This displacement and/or layoff shall not be made in a manner that is arbitrary or in bad faith. c) Where possible, the Employer shall give the Union sixty (60) days notice in writing in the event that the Employer is considering reductions and/or closure of programs, services or supports; layoffs; restructuring; or any other initiatives that would impact the job security of bargaining unit members. The Employer shall meet with the Union within five (5) working days of the written notice at which time the Employer shall discuss with the Union the issues giving rise to the notice. Layoff Procedure. 14.01 A temporary layoff shall be a layoff of two (2) working days or less. The application of plant-wide seniority need not be considered in regard to a temporary layoff. 14.02 When layoffs occur, an employee shall, within twenty four (24) hours of receiving notice of layoff, exercise their plant-wide seniority, subject to their ability to perform the work available in the required manner. Layoff Procedure. The Company will provide the Union with advance notice of all layoffs per the Canada labour Code (2 weeks paid or working notice). It is the desire of the Company and the Union to provide full and efficient employment. The Company recognizes that unnecessary movement of people not only disrupts the employees but also has a negative impact on quality and customer satisfaction. Therefore, the parties agree that when layoffs are occasioned by work shortages or other unforeseen circumstances, the following provisions shall apply. The parties also agree that these provisions shall not apply in the event of scheduled shutdowns. A. Layoffs of Fifteen (15) days or less In the event that it becomes necessary to layoff employees in any classification for a period of a reduction fifteen days or less the following rules will apply. a) The Company will determine the number of affected employees, the affected classifications and the affected occupations. b) Any employees who have not completed their probationary period will be laid off. c) The employees with the shortest seniority in force or of regular hours in one the Occupation will be laid off, subject to the remaining employees being able to meet all requirements of the Hospitalsremaining work available B. Notwithstanding the foregoing, the Union Chair or Vice Chair shall be retained by the Company regardless of seniority as long as there is remaining work available for which he/she can meet all the requirements and provided there are other employees in the bargaining unit who have been retained to work in the office. E. When an employee fails on a displacement and is removed from the job then the displaced employee and any subsequent displaced employees in a particular "chain of displacements" will be returned to their former jobs. This will include extending recall opportunity to the last employee in the chain who may be out of the plant on layoff. F. Displacement Failures - Management agrees that an employee with established seniority who fails on a displacement may, only once in connection with circumstances flowing from an original removal due to lack of work, displace the shortest service employee in the lowest classification in the bargaining unit on whose job it is reasonable to expect that she/he will be able to meet the normal requirements of the work. G. Prior to a layoff either party may request to meet and discuss alternate solutions which, through compromise, provide a mutually satisfactory placement of those individuals laid off and which best suits the continued productivity of all areas concerned. If a mutual agreement is not just reached on a compromise, the hours worked at regular procedures outlined in Article 5 – Seniority will apply H. The Company will undertake the Therapist’s Hospitalfollowing in the situation where an employee's layoff is canceled or extended for more than 30 days: • In such cases an employee in process who bypassed this displacement opportunity as a result of the layoff listing will be granted a displacement interview on request. On the subject of temporary lack of work in an area, the parties agree to co-operate in alleviating the impact on the business. Employees and management will co-operate, and be creative should a circumstance arise, and implement measures such as: • loan out • training • update standards • vacation • other creative measures, etc. An employee may choose immediate layoff instead of the following procedure set out above without losing his/her recall rights.

Such notice to employees may be given during the above referenced their thirty (30) day notification notice of layoff period: 1) Attend a State, but County and/or mutually agreed upon job transition job counseling program. 2) Engage in job search efforts including job interviews. 3) All such activities shall be scheduled with the layoff approval of the affected employee’s supervisor. This shall be in addition to any accrued Paid Time Off the employee may be entitled to. Upon employee request, the Employer shall provide a letter of reference indicating that the employee was laid off for economic and not performance issues. Severance benefits shall be effective prior paid as follows: Employees with five (5) or more complete years of service will receive one (1) week of severance pay pro-rated to the expiration employee’s FTE and rate of that thirty (30) day period. If an insufficient number pay at the time of Therapists volunteer for layoff except in the case where the organization makes the decision to meet reduction goalsno longer provide assisted living services at the ▇▇▇▇▇▇ House, the least senior Therapist occupying positions to be eliminated in which case no severance pay will be displaced, subject only paid out to the ability of the retained employees to perform the duties of the employees to be laid off. Initial displacements shall be carried out by shift. Displaced Therapists will have the right to bump other less senior Therapists within their Hospital providing the Therapist is qualified and has the ability, with no more than two (2) weeks orientation, to competently perform the available work. It is understood that the Hospital will notify the Union of its conclusion that a Therapist has not demonstrated his/her ability within said two (2) weeks prior to terminating the Therapist and the orientation period may be extended by agreement of the parties. Failure to demonstrate competency in the position within the two (2) week period (including any extension of such period agreed to by the Hospital and union) shall be just cause for termination of employment. A Therapist exercising his/her seniority to take a float position must take the entire float position, not just the hours worked at the Therapist’s Hospitalemployee.
