Leave Workers Compensation Sample Clauses
The Leave - Workers’ Compensation clause defines the rights and procedures for employees who are unable to work due to a work-related injury or illness covered by workers’ compensation laws. Typically, this clause outlines the process for notifying the employer, the documentation required, and the duration of leave permitted while the employee recovers. It may also address how benefits such as pay, job protection, and return-to-work arrangements are handled during the leave period. The core function of this clause is to ensure that employees receive appropriate leave and benefits when injured on the job, while providing employers with a clear framework for managing such absences.
Leave Workers Compensation.
(a) Entitlement to Leave An employee shall be granted Workers’ Compensation leave with net pay in the event that the Workers’ Compensation Board/WorkSafe determines that the employee has established a claim (time-loss benefits) and they are unable to perform their duties by reason of the compensable injury which occurred while employed by the Employer. For the purposes of this clause, “net pay” is defined as the employee’s regular net take-home wages to ensure that the non-taxable status of Workers’ Compensation benefits does not provide an opportunity for an injured worker to earn more while on claim than if they were working. The term claim will not include any form of WCB allowance or pension, and this section will not be operative while an employee is receiving such a different form of payment from WCB arising from this claim. Additional shifts worked by part-time employees, shift and weekend premiums, and statutory holiday premiums (in accordance with the three (3) arbitration awards listed below) shall be taken into account when calculating “regular net take-home wages”: • Surrey Memorial Hospital and BCNU; ▇▇▇▇▇▇ ▇▇▇▇▇▇; April 1, 1996. • Peace Arch Hospital and BCNU; ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇; December 2, 1997. • Vancouver Hospital and Health Sciences Centre and BCNU; ▇▇▇▇▇▇ ▇▇▇▇▇▇; January 28, 1998.
