LEVEL 1 GRIEVANCE Sample Clauses

LEVEL 1 GRIEVANCE. A grievance shall be submitted in writing at Level 1 to the Immediate Supervisor (or Designee) within fifteen (15) calendar days of the occurrence giving rise to the grievance. The grievance shall state the nature and the date of the occurrence giving rise to the grievance, the Article(s) and the Section(s) of the Agreement on which the grievance is based, and the relief or remedy sought. The Union representative, employee, and the Level 1 Supervisor or Designee shall discuss the issue within ten (10) calendar days of receipt of the written grievance. An employee who is required to attend meetings outside of scheduled working hours shall be paid for the time spent at their normal rate of pay. The Level 1 Supervisor or Designee will issue a written decision within ten (10) calendar days of this meeting. Failure to do so will be deemed a denial of the grievance and will allow the Union to advance the grievance to Level 2.
LEVEL 1 GRIEVANCE. If the grievance is not resolved informally, and the grievant wishes to continue to address the grievance, the grievant shall file the written grievance with their immediate building Principal. The written grievance shall state: 1. The District policy or provision of the Master Agreement the employee believes was violated 2. The alleged date of violation 3. The actor involved in the alleged violation 4. The remedy requested by the employee The written grievance must be filed with the immediate building Principal within fifteen (15) working days of the date of the initial event allegedly giving rise to the grievance. The immediate building Principal or designee of the building Principal shall meet with the grievant and shall, at the discretion of the Principal or designee, conduct whatever additional meetings or investigative activities the Principal or designee believes are necessary to address the grievance. Subsequent to these activities and within a period of ten (10) working days, the Principal shall provide the grievant with a written response to the grievance of the certificated employee.

The Employer’s response shall be addressed to the grievant and/or the Advocate or Union Representative.

  • Group Grievance Where a number of employees have identical grievances and each employee would be entitled to grieve separately they may present a group grievance in writing signed by each employee who is grieving to the Administrator or her designate within ten (10) days after the circumstances giving rise to the grievance have occurred or ought reasonably to have come to the attention of the employee(s). The grievance shall then be treated as being initiated at Step No. 1 and the applicable provisions of this Article shall then apply with respect to the processing of such grievance.

  • Grievance Mediation Nothing in this Article precludes the Parties from mutually agreeing to grievance mediation during any stage of the grievance procedure. The agreement shall be made in writing and stipulate the name of the person and the time line for grievance mediation to occur.

  • Policy Grievance – Union Grievance The Union may institute a grievance alleging a general misinterpretation or violation of this Agreement by the Employer by submitting a written grievance at Step No. 1 within twenty (20) days after the circumstances have occurred. This section shall not apply to disciplinary grievances or application of competitive clauses under this Agreement.

  • Policy Grievance Where either Party disputes the general application, interpretation or alleged violation of an article of this Agreement, the dispute shall be discussed initially with the Employer or the Union, as the case may be, within thirty (30) days of the occurrence. Where no satisfactory agreement is reached, either Party may submit the dispute to arbitration, as set out in Article 10.
