Levels and Flows. It is acknowledged that in the future, the levels and flows, including fluctuations and timing thereof, of the Project Influenced Waterways within the Resource Area shall, from time to time, exceed the maximum and fall below the minimum levels and flows, and shall vary from the fluctuation and timing experienced or anticipated in the Post Project Water Regime. To the extent such occurrences are caused by, or attributable to the Project, they shall be considered to be deviations from the Post Project Water Regime.
