Common use of Liability Limitation Clause in Contracts

Datasite will not be liable for indirect, consequential, or special damages, including lost profits, regardless of the form of the action or the theory of recovery, even if advised of the possibility of those damages; and, in no event will Datasite’s liability to Supplier exceed the amount of fees payable under this order.
