Common use of Liability of the State Clause in Contracts

Liability of the State. The LESSEE agrees that neither the STATE nor any of its officials, employees, agents or contractors shall be liable for money damages for any loss caused to the LESSEE, its agents or contractors, by reason of decisions made in respect to the application and administration of this LEASE; provided, however, this section does not excuse the STATE, its officials, employees, agents or contractors from liability for damages or injuries resulting from other acts that result from the negligence or willful misconduct of the STATE.
