Common use of Liability to the public Clause in Contracts

Liability to the public. The Company will indemnify the Insured against all sums for which the Insured may be held legally liable: As a private ▇▇▇▇▇▇▇▇▇▇▇ occupying the Private Dwelling House in respect of accidents in or about the Private Dwelling House. Occurring during the Period of Insurance and resulting in: 1. Bodily injury to any person not being a member of the Insured's family or household nor at the time of sustaining such ▇▇▇▇▇▇ engaged in the Insured's service. 2. Damage to property not belonging to or in the charge of or under the control of the Insured or of a member of his family or household or of a person in his service. Provided always that the amount payable hereunder in respect of any one accident or series of accidents constituting one occurrence shall not in any case exceed the sum specified in the Schedule. The Company will, in addition, indemnify the Insured in respect of: a) Legal costs and expenses recoverable from the Insured by any claimant provided such costs and expenses were incurred before the date (if any) on which the Company shall have paid or offered to pay either the full amount of the claim or the total amount recoverable in respect of any one occurrence as herein before provided; b) Legal costs and expenses incurred by the Insured with the consent of the Company. Provided also that the Company shall not in any case be liable hereunder in respect of: A. Injury or damage arising out of or incidental to: a) the Insured's profession or business, or b) the ownership, possession or use by or on behalf of the Insured of any lift, vehicle, vessel or craft of any kind. c) the carrying out of alterations, additions, repairs or decorations to the insured premises. B. Liability arising out of any contract of indemnity which imposes upon the Insured liability which the Insured would not otherwise have been under. In the event of the death of the Insured the Company will in respect of the liability incurred by the Insured indemnify the Insured's personal representatives in the terms of and subject to the limitations of this Section provided that such personal representatives shall as though they were the Insured observe, fulfill and be subject to the Terms or this Policy so far as they can apply. This Section shall not apply to any part of the Private Dwelling House used in connection with the profession of the Insured whilst that part of the Private Dwelling House is being so used. For the purposes of this section the expression "the lnsured” shall be deemed to include the husband or wife of the Insured. Limit of amount of the Company's liability under this Section is RM50,000.00 any one accident or series of accidents constituting one occurrence and in the aggregate.

The Company will indemnify the Insured against This extension covers: (a) all sums for which the Insured may be held insured is legally liable: As liable as a private ▇▇▇▇▇▇▇▇▇▇▇ occupying the Private Dwelling House premises or any member of the insured’s family normally residing with the insured for compensation in respect of: (i) death of or bodily injury to or illness of any person (ii) physical loss of or damage to tangible property occurring during the period of insurance as a result of an accident (b) all legal costs and expenses: (i) recovered by any claimant against the insured (ii) incurred with the written consent of the company in respect of a claim against the insured for compensation to which the indemnity expressed in this extension applies Provided that: the amount payable in respect of any one accident or series of accidents in or about the Private Dwelling Housearising out of one event will not exceed R5 000 000 (five million rand) inclusive of all compensation and all legal costs and all other costs and expenses. Occurring during the Period of Insurance and resulting inThe indemnity provided by this extension does not apply to nor include: 1. Bodily (a) liability assumed by the insured by agreement and which would not have attached in the absence of the agreement (b) liability in respect of death of or bodily injury to or illness of any person not being who is a member of the Insured's insured’s household or family whether residing with the insured or household nor at not (c) liability in respect of death of or bodily injury to or illness of any person under a contract of service or apprenticeship with the time insured if the liability is in respect of sustaining such ▇▇▇▇▇▇ engaged death, bodily injury or illness arising out of and in the Insured's service.course of the employment of the person by the insured 2. Damage (d) liability in respect of loss of or damage to property not belonging to or in the charge of or under the control of the Insured insured or of a any member of his the insured’s family or household or of a person in his service. Provided always that any domestic worker or agent of the amount payable hereunder insured (e) liability in respect of death, bodily injury, illness, loss or damage caused by or in connection with or arising from: (i) any one accident profession or series business of accidents constituting one occurrence shall not in any case exceed the sum specified in insured (ii) the Schedule. The Company will, in addition, indemnify ownership or possession or use by or on behalf of the Insured insured of lifts or mechanically propelled vehicles or trailers other than pedestrian controlled gardening implements (iii) deliberate or malicious acts (iv) explosives (f) liability in respect of: a(i) Legal claims for compensation, legal costs and expenses recoverable for death, any injury, illness, loss or damage directly or indirectly caused by or by means of or as a result of or originating from the Insured by any claimant or attributable to seepage, pollution or contamination provided such always that this proviso shall not apply to claims for compensation and/or legal costs and expenses were in respect of the accidental death of or bodily injury to or illness of any person or accidental physical loss of or damage to tangible property where such seepage, pollution or contamination is caused by a sudden unintended and unforeseen occurrence during the period of insurance (ii) any costs of removing, nullifying or cleaning up seeping, polluting or contaminating substances unless the seepage, pollution or contamination is caused by a sudden, unintended and unforeseen occurrence Provided that: this proviso shall not extend this sub-section to cover any liability which would have been insured under this sub-section in the absence of this proviso (g) claims for compensation and legal costs and expenses in respect of death, injury or illness attributable to a gradual working cause which did not occur from a sudden and identifiable accident or occurrence (h) liaility for fines or penalties or punitive, exemplary or vindictive damages awarded in any court (i) costs and expenses incurred before subsequent to the date (if any) on which the Company shall have company has paid or offered to pay either the full amount of the claim or the total amount recoverable in respect of any one occurrence as herein before provided; b) Legal costs and expenses incurred by the Insured with the consent of the Company.
