Liability to Third Parties. Subject to such other undertakings as are provided for in this Consortium Agreement, each Participant shall be solely liable for any loss, damage or injury to third parties resulting from the performance (or non-performance) of the said Participant’s obligations by it or on its behalf under this Consortium Agreement, the PPP Allowance Agreement or from its use of the Background and Foreground.
