Common use of License Conditions Clause in Contracts

License Conditions. You may not do or attempt to do any of the following with respect to the Software or any of its parts: (a) use it commercially or for a promotional purpose except as Epic expressly authorizes; (b) copy, reproduce, distribute (including via a network server), display, or use it in a way that is not expressly authorized in this Agreement; (c) sell, rent, lease, license, distribute, or otherwise transfer it; (d) reverse engineer, derive source code from, modify, adapt, translate, decompile, or disassemble it or make derivative works based on it; (e) remove, disable, circumvent, or modify any proprietary notice or label or security technology included in it; (f) create, develop, distribute, or use any unauthorized software programs to gain advantage in any online or other game modes; (g) use it to infringe or violate the rights of any third party, including but not limited to any intellectual property, publicity, or privacy rights; (h) use, export, or re-export it in violation of any applicable law or regulation; or (i) behave in a manner which is detrimental to the enjoyment of the Software by other users as intended by Epic, in Epic’s sole judgment, including but not limited to the following – harassment, use of abusive or offensive language, game abandonment, game sabotage, spamming, social engineering, scamming, running or using methods which are not authorized by Epic and which interfere with the outcome and/or the course of the Software (including Cheats, bots, scripts, or mods not expressly authorized by Epic) by giving you and/or another user an advantage over other players who do not use such methods, or making or otherwise contributing to such unauthorized software. The Software may contain Cheat Detection software or features or you may be prompted to install Cheat Detection software during your installation of the Software. If you do not agree to install the Cheat Detection software or at any time remove or disable the Cheat Detection software or features, the License granted to you automatically terminates and you may not make use of the Software. The Software or the Cheat Detection software may collect and transmit details about your account, gameplay, and potentially unauthorized programs or processes in connection with Cheat Detection, subject to Epic’s Privacy Policy. In the event that Cheats are identified, you agree that Epic may exercise any or all of its rights under this Agreement.

License Conditions. This license is subject to the following limitations ("License Limitations"). Any use of the Program in violation of the License Limitations will result in an immediate termination of your license, and continued use of the Program will be an infringement of Activision's copyrights and other rights in and to the Program. You may agree that you will not do do, or attempt to do allow, any of the following with respect to the Software or any of its partsfollowing: (a1) exploit the Program commercially; (2) subject to any system requirements, use the Program on more than one system at the same time; (3) make copies of the Program, in whole or in part; (4) without limiting the foregoing clause (3), copy the Program onto a hard drive or other storage device unless the Program itself makes a copy during installation, or unless you are downloading the Program from an authorized Activision online retailer; (5) use it commercially the Program in a network, multi-user arrangement, or for a promotional purpose remote access arrangement, including any online use except as Epic expressly authorizesincluded in the Program functionality; (b) copy, reproduce, distribute (including via a network server), display, or use it in a way that is not expressly authorized in this Agreement; (c6) sell, rent, lease, license, distribute, or otherwise transfer itthe Program; (d7) subject to applicable laws, reverse engineer, derive source code fromcode, modify, adapt, translate, decompile, disassemble, or disassemble it or make create derivative works based on itof the software and other proprietary technology in the Program, in whole or in part; (e) remove, disable, circumvent8) hack or modify the Program, or modify any proprietary notice or label or security technology included in it; (f) create, develop, modify, distribute, or use any unauthorized software programs to gain advantage in any offline, online or other multiplayer game modes, such behavior will be subject to sanction at Activision’s discretion; (g9) use it to infringe remove, disable, or violate circumvent any proprietary notices or labels contained on or within the rights Program; or (10) export or re-export the Program in violation of any third partyapplicable laws or regulations of the United States government. Unless expressly permitted by Activision and subject to applicable local laws, you agree that the Guitar Controller (and software therein) may not be used with any software product other than the Guitar Hero game product, and your limited license to use the software in the Guitar Controller is expressly conditioned on your use of the Guitar Controller with a Guitar Hero game product. Any other use is prohibited and no other license, express or implied, is granted. You agree not to do any of the following actions while using the Program: (A) harass, threaten, embarrass or cause distress or discomfort upon another participant, user, or other individual or entity; (B) transmit any UGC (as defined in Section 14) that Activision considers to be disruptive, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, sexually, ethnically or otherwise objectionable; (C) impersonate any person or entity, including but not limited to any intellectual property, publicityActivision; (D) disrupt normal Program functionality, or privacy rightsotherwise act in a manner that negatively affects other participants and/or the overall Program experience; (hE) usepost or transmit any unsolicited advertising, exportpromotional materials, or re-export it in violation any other forms of solicitation; (F) intentionally or unintentionally violate any applicable law law, regulation or regulationtreaty while using or accessing the Program; (G) post multiple posts of the same content (i.e., “spam”); or (iH) behave invade the privacy or violate or infringe any right of any person or entity, including, without limitation, any intellectual property right. Parents and guardians of children under the age of majority in a manner which their jurisdiction or 18 years of age, whichever is detrimental to the enjoyment older, agree that you will be responsible for all uses of the Software Program by other users as intended by Epic, in Epic’s sole judgment, including but your child whether or not limited to the following – harassment, use of abusive or offensive language, game abandonment, game sabotage, spamming, social engineering, scamming, running or using methods which are not such uses were authorized by Epic and which interfere with the outcome and/or the course of the Software (including Cheats, bots, scripts, or mods not expressly authorized by Epic) by giving you and/or another user an advantage over other players who do not use such methods, or making or otherwise contributing to such unauthorized software.
