Common use of Limitation of Liability of Trustee Clause in Contracts

Limitation of Liability of Trustee. Notwithstanding anything contained herein to the contrary, these Master Sale Terms and any Sale Agreements will be, signed by Chase Bank USA, National Association, not in its individual capacity but solely in its capacity as Trustee for the Purchaser and Interim Trustee for the Seller, as the case may be, and in no event shall Chase Bank USA, National Association in its individual capacity, have any liability for the representations, warranties, covenants, agreements or other obligations of the Trustee, the Interim Trustee, the Purchaser or the Seller under these Master Sale Terms or any Sale Agreements or in any of the certificates, notices or agreements delivered pursuant hereto, as to all of which recourse shall be had solely to the assets of the Purchaser or the Seller, as the case may be.
