Limitation on Decision-Making Authority. Notwithstanding anything to the contrary, none of the committees or subcommittees contemplated by this Article 3 nor any Senior Executive pursuant to this Article 3 shall be entitled to determine any matters for which: (a) one or more of the Parties is allocated decision-making authority elsewhere in this Agreement; or (b) such determination would violate or permit the violation of any express provision of this Agreement, including, without limitation, the provisions of Sections 3.3(f), 3.3(g), 3.3(h), 3.4(e) and 3.5
