Common use of Limitation on Liability of the Note Holders Clause in Contracts

Limitation on Liability of the Note Holders. Each Initial Note Holder shall have no liability to the other Note Holders with respect to its Note except with respect to losses actually suffered due to the gross negligence, willful misconduct or breach of this Agreement on the part of such Initial Note Holder.
