Limitations on Our Liability. We try to ensure that you can always use your card. Occasionally, however, you may not be able to do so because of systems or communication problems involving a merchant, the network or us. We may also block use of your card or a particular type of transaction for any reason and without telling you, including in cases where we suspect unauthorized or fraudulent use of the card. Under no circumstances are we liable to you if you cannot use your card.
Limitations on Our Liability. If we break this agreement, we won't be liable to you for losses and costs caused by abnormal or unforeseeable events, that we cannot reasonably control and which would've been unavoidable despite all reasonable efforts to prevent the event happening.
Limitations on Our Liability. Notwithstanding anything in the Transfer Money Terms that may be viewed or deemed to be in conflict with this provision, you agree that our liability with respect to the Transfer Money Services shall not exceed that which is required by law.

We shall not be responsible for the acts or omissions of you or your Occupants (including without limitation the amount, accuracy, timeliness of transmittal or authorization of any requested debit or credit initiated through ZRent) or those of any other person, including without limitation any Federal Reserve Financial Institution, Automated Clearing House of transmission or communications facility, any Receiver or Receiving Depository Financial Institution (including without limitation the return of an Entry by such Receiver or Receiving Depository Financial Institution), and no such person shall be deemed our agent. You agree to indemnify us against any loss, liability or expense (including attorney’s fees and expenses), resulting from or arising out of any claim of any person that we responsible for any act or omission of you, your Occupants, or any other person described in this section. In the event of a determination that we are responsible for willful misconduct, we shall be liable only for your actual damages; in no event shall ZRent be liable for any consequential, special, incidental, punitive or indirect loss or damage which you may incur or suffer in connection with this Agreement, whether or not the likelihood of such damages was known or contemplated by us and regardless of the legal or equitable theory of liability which you may assert, including, without limitation, loss or damage from subsequent wrongful dishonor resulting from our acts or omissions pursuant to this Agreement. Without limiting the generality of the foregoing provisions, we shall be excused from failing to act or delay in acting if such failure or delay is caused by legal constraint, interruption of transmission or communication facilities, equipment failure, war, emergency conditions or other circumstances beyond our control. In addition, we shall be excused from failing to transmit or delay in transmitting any debit or credit if such transmittal would result in our having exceeded any limitation upon our intra-day ...
Limitations on Our Liability. If EmbassyCard break the Agreement, we will not be liable to you for losses and costs caused by abnormal or unforeseeable event, that we cannot reasonably control and which would have been unavoidable despite all reasonable efforts to prevent the event happening.
Limitations on Our Liability. We are not responsible or liable for any damages, including special, indirect and consequential damages, even if they were foreseeable, that may result from the use of your Card or Account, or obligation under the Agreement if, for any reason, your Card or your Account number is not accepted or you are unable to access your Account, including the inability to access your Account by reason of a business interruption, security breach, delay, loss, error, system outage, or failure to access any ABM, terminal or other machine or equipment with your Card.
Limitations on Our Liability. We try to ensure that your Credit Card and Account number are accepted when presented. However, we will not be liable to you for damages (including special, indirect or consequential damages) that may result if, for any reason, your Credit Card or your Account number is not accepted or you are unable to access your Account. We may decide to cancel this Agreement at any time without telling you in advance. If we do, you must pay all amounts owing on your Account, stop using your Credit Card and return your Credit Card to us. We may deduct amounts owing on your Account from any other account you have with us and use them to pay the amount owing on your Account, without notice to you. You may also cancel this Agreement by telling us. We may require that any cancellation be done in writing. Until you pay us the total amount you owe on your Account, this Agreement will remain in effect. Limitations on Our Liability. 20.1. We will not be liable to you for damages (including special, indirect and consequential damages) that may arise in connection with your inability to access, or a merchant’s refusal to honour or accept your Card or your Account, or the modification, cancellation or replacement of the Card’s advantages or discounts by a supplier. 20.2. We may use affiliates and service providers that are located outside of Canada to process applications, information, and transactions in connection with credit card accounts. In the event that an affiliate and/or a service provider cannot or will not process any transaction in connection with your Account, by reason that the affiliate or service provider may suffer legal and/or reputational risks, or that the affiliate or service provider may, by doing so, violate any law, regulation, rule or internal policy applicable to it if it completes such transaction, then we may be unable to complete the transaction. In such event, neither we nor our affiliates or service providers will be liable in respect of any such incomplete transaction.
Limitations on Our Liability. 8.1 The exclusions and limitations on our liability set out in the merchant terms and conditions also apply to exclude and limit our liability in relation to this additional service. 8.2 As well as the limitations and exclusions on our liability set out in the merchant terms and conditions: (a) We have no control or responsibility for any extra charges imposed by other organisations or people on you, your customers or anyone else if the trading currency used to make any payment is a non-like-for-like currency; (b) We have no liability for any losses that arise from or in connection with: (i) changes or volatility in currency (which may affect the exchange rates available (including the availability of exchange rates) or your calculation of any settlement payment using any currency exchange rate which is outside of our control); (ii) a delay in rate card issuance for any reason; or (iii) a suspension in a rate card due to 8.3 The indemnities (meaning, in plain English, making good each other’s losses) you give us in the merchant terms and conditions will cover all losses we suffer which may arise as a result of any act or failure to act on your part or on your behalf in relation to this 8.4 Any claim you want to make against us in relation to this additional service is limited in the same way as set out in the merchant terms and conditions.
