Liquidating Trustee Action. The Liquidating Trustee shall hold, collect, conserve, protect and administer the Liquidating Trust in accordance with the provisions of this Liquidating Trust Agreement and the Plan, and pay and distribute amounts as set forth herein for the purposes set forth in this Liquidating Trust Agreement. The Liquidating Trustee shall exercise its business judgment for the benefit of the Beneficiaries in order to maximize the value of the Assets and Distributions, giving due regard to the cost, risk, and delay of any course of action. Any good faith determination by the Liquidating Trustee as to what actions are in the best interests of the Liquidating Trust shall be determinative.
