Common use of Litigation Settlements Clause in Contracts

Litigation Settlements. Section 6.17 of the Credit Agreement is amended and restated in its entirety as follows: “Litigation Settlements. Settle any civil litigation brought against any of the Loan Parties if the settlement amount paid or required to be paid by the Loan Parties would exceed, either individually or in the aggregate with all other civil litigation settlement payments paid or required to be paid by the Loan Parties (a) during the period from the Closing Date to July 18, 2007, $75.0 million, and (b) during any period of 12 consecutive months thereafter, $15.0 million, in each case, net of any insurance proceeds.”
