Common use of Living Wage Coverage Determination Clause in Contracts

Living Wage Coverage Determination. An initial determination has been made that this is a Permit under the LWO, and, that it is not exempt from coverage by the LWO. Determinations as to whether this Permit is a license covered by the LWO, or whether an employer or employee is exempt from coverage under the LWO are not final, but are subject to review and revision as additional facts are examined and/or other interpretations of the law are considered. In some circumstances, applications for exemption must be reviewed periodically. City shall notify Permittee in writing about any redetermination by City of coverage or exemption status. To the extent Permittee claims non-coverage or exemption from the provisions of the LWO, the burden shall be on Permittee to prove such non- coverage or exemption.
