Common use of Loan Instruments Clause in Contracts

Loan Instruments. The term "Loan Instruments" shall mean this Loan Agreement, the Mortgage, the Acquisition Note, the Renovation Note, the Guarantee, the financing statements, and such other instruments evidencing, securing, perfecting or pertaining to the Loan as shall, from time to time, be executed and delivered to Lender by Borrower, Guarantor, or any other party to Lender pursuant to this Loan Agreement, including, without limitation, each Affidavit of Borrower, each Application for Advance, and the Approved Budget.

Loan Instruments. The term "“Loan Instruments" ” shall mean this Loan Agreement, the Deed of Trust or Mortgage, the Acquisition Note, the Renovation NoteGuaranty Agreement, the GuaranteeSecurity Agreement, the financing statementsFinancing Statements, and such other instruments evidencing, securing, perfecting or pertaining to the Loan as shall, from time to time, be executed and delivered to Lender by Borrower, Guarantor, Guarantor or any other party to Lender pursuant to this Loan Agreement, including, without limitation, each Affidavit of Borrower, each Application for Advance, and the Approved Budgetany future amendments or supplements thereto.

The term "“Loan Instruments" ” shall mean include this Loan Agreement, the MortgageNote including all renewals, extensions and modifications thereof), the Acquisition Note, the Renovation Note, the Guarantee, the financing statements, and such other instruments evidencing, securing, perfecting or pertaining to the Loan as shall, from time to time, be executed and delivered to Lender by Borrower, Guarantor, or any other party to Lender pursuant to this Loan Agreement, including, without limitation, each Affidavit of BorrowerMortgage, each Application for Advance, the Assignment of Leases and Rents, the Approved BudgetFinancing Statements, and all other documents and security instruments executed pursuant hereto or in connection herewith, or as evidence of or security for payment of the Loan or of performance of Borrower’s obligations under this Loan Agreement or other Loan Instruments.
