Common use of LOSS OF POSITIONS Clause in Contracts

LOSS OF POSITIONS. When positions change as a result of implementation of new technologies and such changes could result in the layoff of employees, the Employer shall fill those positions with current employees who have expressed a desire to perform in the new positions, and where the Employer has a reasonable expectation that the employee is capable of effectively performing in the new position. If a current employee is not selected to fill the position, the Employer shall make efforts to transfer the employee to a comparable job within the College. Such efforts could include the necessity for some on-the-job training.
