Maintenance and Warranty. Tata Tigor EV/Mahindra eVerito: The vehicles would be provided with comprehensive free annual maintenance contract (AMC) for a period of 5 years, the terms of which are as stated in Annexure 1. The E-Cars would carry a warranty of 5 years against any manufacturing defect. The car batteries would carry a free replacement warranty up to 5 years or 1,00,000 kms, whichever occurs earlier. The battery would be replaced only if the battery capacity reduces below 75% of its capacity. The cars would also carry a free of charge periodic servicing for a period of 5 years, in terms of the conditions set out in Annexure 2. If required, the car tyres would be replaced once every 30 months. The maintenance and warranty so offered by ANERT would be only in consonance with the terms and conditions set out in the agreement executed by ANERT with EESL and the liability of ANERT under this agreement would be restricted to the maintenance and warranty promised by EESL to ANERT under that agreement.

Maintenance and Warranty. (1) The Licensor guarantees to maintain the contractually agreed quality of the Software during the term of the Agreement and also guarantees that no third-party rights can prevent the contractual use of the Software. The Licensor will correct any material and legal defects in the leased object within a reasonable time. If the defect has no effect or only a minor adverse effect on the Software, ▇▇▇▇ is entitled to remedy the defect by delivering a new version or an update as part of ▇▇▇▇’▇ version and update planning program. The same applies to defects of third-party programs if these defects do not impair the functionality or impair it only to a minor extent. (2) The Licensee must notify the Licensor in writing of defects in the Software immediately upon discovering them. All notices of defects must be submitted in writing with a verifiable description of the defect symptoms and, if possible, must be accompanied by written notes, hard copies or other documents illustrating the defects. (3) However, in cases where the Software is combined with external software by the Licensee, ▇▇▇▇ will accept no liability for defects in relation to the compatibility of such external software with the Software, nor will it accept liability for defects that relate to the non-contractually agreed use or improper operation of the Software by the Licensee or in the event that the Licensee is not using the required system configuration, in particular infrastructure, hardware, operating system and database. Failure to ensure the Equipment is maintained and serviced in accordance with this condition 7.3 shall invalidate the warranties provided under conditions 7.1 and 7.2. 7.4 ADF warrants all Services provided pursuant to these Conditions of Supply shall be provided using reasonable care and skill using employees or sub-contractors with appropriate skill and expertise. 7.5 ADF shall not be liable for a breach of any of the warranties in this condition 7 if: 7.5.1 the Customer makes any further use of the Goods and/or Equipment (and any Equipment and/or Goods intended to be used in conjunction with the affected Goods and/or Equipment) after identifying the possible defect; or 7.5.2 the defect arises because the Customer failed to follow ADF’s oral or written instructions as to the storage, commissioning, use or maintenance of the Equipment and/or Goods; or 7.5.3 the Customer alters or repairs such Equipment and/or Goods without the written consent of ADF. 7.6 Subject to the provisions of this condition 7, if any of the Equipment and/or Services and/or Goods do not conform with any of the warranties in this condition 7, ADF shall at its option repair or replace, or in the case of the Services, remedy, such Equipment and/or Services and/or Goods (or any defective part) or refund the price of such Equipment and/or Services and/or Goods (or defective part) provided that, if ADF so requests, the Cus...
