Common use of Maintenance of Property Clause in Contracts

Maintenance of Property. The Company shall maintain, and shall cause each Subsidiary to maintain, and preserve all its property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have a Material Adverse Effect.

Maintenance of Property. The Company shall maintain, and shall cause each the Subsidiary to maintain, Borrowers and preserve the Significant Subsidiaries maintain all its property which is used or useful in its business Property and keep such Property in good repair, working order and conditioncondition in accordance with customary and prudent business practices for similar businesses, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have cause a Material Adverse Effect.

Maintenance of Property. The Company shall maintainwill, and shall will cause each Subsidiary to maintainto, keep and preserve maintain all of its property which is used Properties necessary or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto renewals, replacements, additions and renewals and replacements thereof improvements thereto, except where the failure to do so could not reasonably be expected to have a Material Adverse Effect.

The Company shall maintainshall, and shall will cause each Subsidiary to maintainof its Significant Subsidiaries to, maintain all of their properties and preserve all its property which is used or useful assets necessary in the operation of its business in good condition, repair and working order and conditionorder, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof excepted, except where the failure to do so could maintain the same, either individually or in the aggregate, has not had, and would not reasonably be expected to have have, a Material Adverse Effect.

Maintenance of Property. The Subject to transactions permitted by Section 7.02 or Section 7.03, the Company shall maintain, and shall cause each Subsidiary to maintain, and preserve all its property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof excepted, except where to the failure to do so could extent that noncompliance would not reasonably be expected to have a Material Adverse Effect.

The Company shall maintain, and shall cause each Subsidiary of its Subsidiaries and each Permitted Partnership to maintain, and preserve all of its property Property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have a Material Adverse Effect.

The Company shall maintainwill, and shall will cause each Subsidiary to maintainto, keep and preserve maintain all its property which is used of the material Properties necessary or useful in its their business taken as a whole in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto material renewals, replacements, additions, betterments and renewals improvements thereto; provided, however, that nothing in this Section shall prevent the Company or any Subsidiary from discontinuing the operating and replacements thereof except where maintenance of any of its Properties if such discontinuance is, in the failure judgment of the Company, desirable in the conduct of its business and not disadvantageous in any material respect to do so could not reasonably be expected to have a Material Adverse Effectthe Banks as holders of the Notes.

The Company shall maintainshall, and shall cause each Subsidiary to maintainof its Subsidiaries to, maintain and preserve all its property which is used or useful in material to the normal conduct of its business in good working order and condition, ordinary wear and tear excepted excepted, other than obsolete, worn out or surplus equipment and will from time to time make all necessary repairs thereto and appropriate renewals and replacements thereof except where the failure to do so could would not reasonably be expected to have a Material Adverse Effect.
