Common use of Manner of Carrying Out the Services Clause in Contracts

Manner of Carrying Out the Services. 5.1 The Service Provider shall make no delivery of Equipment or other things nor commence any work in the Establishments without obtaining the Purchaser's prior consent which shall not be unreasonably withheld. 5.2 Access to the Establishments shall not be exclusive to the Service Provider but only such as shall enable it to carry out the Services concurrently with the execution of work by others. The Service Provider shall co-operate with such others as the Purchaser may reasonably require by notice. 5.3 All Equipment or materials brought into the Establishments shall be at the risk of the Service Provider and the Purchaser shall have no liability for loss of or damage to any Equipment or materials unless the Service Provider is able to demonstrate that such loss or damage was caused by the negligence of the Purchaser. 5.4 On completion of the Services the Service Provider shall remove its Equipment and unused materials and shall clear away from the Establishments all rubbish arising out of the Services and leave the Establishment in a neat and tidy condition. 5.5 The Service Provider shall obtain the Purchaser’s prior approval before introducing new methods or systems in providing the Services.

Manner of Carrying Out the Services. 5.1 The Service Provider shall make no delivery of Equipment materials, equipment, or other things nor commence any work in of the Establishments Services within the Premises without obtaining the Purchaser's or the controller of the relevant Premises prior consent which shall not be unreasonably withheld. 5.2 Access to the Establishments Premises shall not be exclusive to the Service Provider but only such as shall enable it to carry out the Services concurrently with the execution of work by others. The Service Provider shall co-operate with such others as the Purchaser may reasonably require by noticerequire. 5.3 All Equipment or equipment and materials brought into on to the Establishments Premises shall be at the risk of the Service Provider and the Purchaser shall have no liability for loss of or damage to any Equipment equipment or materials unless the Service Provider is able to demonstrate that such loss or damage was caused by the negligence of the Purchaser. 5.4 On completion of the Services the Service Provider shall shall, on a daily basis, remove or secure its Equipment and unused materials and shall clear away from the Establishments all rubbish arising out of the Services equipment, and leave the Establishment Premises in a neat and tidy condition. 5.5 The Service Provider shall obtain the Purchaser’s prior approval before introducing new methods or systems in providing which materially affect, or may affect, the scope, performance or method of delivery of Services.
