Manner of Collection. (1) After CDCR/CCHCS has determined that liquidated damages are to be assessed, CDCR/CCHCS shall notify the Contractor in writing of the reason for and amount of the assessment(s). The assessment notice shall be sent to the Contractor by certified mail, return receipt requested, or by any other method, which provides evidence of receipt. At CDCR/CCHCS’ discretion, the assessment notice may direct payment of the assessment by the Contractor. If payment is thus directed, the Contractor shall pay the assessment within thirty (30) calendar days of receipt of the assessment notice. (2) Any liquidated damages assessment may also be collected, at CDCR/CCHCS’ discretion, by offsetting the funds from payment(s) due to the Contractor after the date of assessment, in the manner set forth in Section 63, Overpayments and Offsets provision of this exhibit.
