MARINE ENVIRONMENT Clause Samples

The MARINE ENVIRONMENT clause establishes the parties' obligations to protect the marine environment during the performance of their contractual activities. MARINE ENVIRONMENT. (a) Australia and East Timor shall cooperate to protect the marine environment of the JPDA so as to prevent and minimize pollution and other environmental harm from petroleum activities. Special efforts shall be made to protect marine animals including marine mammals, seabirds, fish and coral. Australia and East Timor shall consult as to the best means to protect the marine environment of the JPDA from the harmful consequences of petroleum activities. (b) Where pollution of the marine environment occurring in the JPDA spreads beyond the JPDA, Australia and East Timor shall cooperate in taking action to prevent, mitigate and eliminate such pollution. (c) The Designated Authority shall issue regulations to protect the marine environment in the JPDA. It shall establish a contingency plan for combating pollution from petroleum activities in the JPDA. (d) Limited liability corporations or limited liability entities shall be liable for damage or expenses incurred as a result of pollution of the marine environment arising out of petroleum activities within the JPDA in accordance with: (i) Their contract, licence or permit or other form of authority issued pursuant to this Treaty; and (ii). The law of the jurisdiction (Australia or East Timor) in which the claim is brought.

Such measures may include: (a) spatial closures within the Area; (b) temporal closures of target fisheries; (c) the regulation of fishing methods and gear-types used, including the prohibition of certain gear types that may have an impact on associated or dependent species and/or vulnerable or unique habitats or ecosystems; (d) measures to mitigate the effects of lost or abandoned fishing gear on vulnerable marine ecosystems; (e) measures to reduce pollution from fishing vessels operating in the Area, and the effects of any such pollution; (f) Information exchange and co-ordination with relevant organisations, including organisations with responsibility for land-based sources of pollution and vessel- source pollution. 2. The Meeting of Parties, in adopting the conservation and management measures referred to in paragraph 1 of this article, shall take full account of advice from the Scientific Committee and other relevant sources of information, including in particular, information from other regional organisations.

The Employer commits to investigate the use of environmentally friendly products. It will be the Employer's responsibility to ensure that all working areas and employer-owned vehicles are maintained in a safe and clean condition.

  • NON-SEXIST ENVIRONMENT 1. A non-sexist environment is defined as that in which there is no discrimination against females or males by portraying them in gender stereotyped roles or by omitting their contributions. 2. The employer does not condone and will not tolerate any written or verbal expression of sexism. In September of each school year the employer and the local shall jointly notify administrative officers and staff, in writing, of their commitment to a non-sexist environment. 3. The employer and the local shall promote a non-sexist environment through the development, integration, and implementation of non-sexist educational programs, activities, and learning resources for both staff and students.

  • Protection of the Environment If the Contractor encounters circumstances such as weather conditions or site factors where the Contractor knows or should reasonably know that proceeding with the Work may, directly or indirectly, cause Environmental Damage, the Contractor shall:
