Common use of Marketing of the Project Clause in Contracts

Marketing of the Project. (a) The Concessionaire shall be solely responsible for the marketing of the Project. The Concessionaire shall be entitled to commence such marketing at its cost and risk from the COD and to accept advances, premium, booking amounts and other considerations from such users from such date; provided that Authority shall not be liable in any manner whatsoever to any Person in this behalf and the Concessionaire shall disclose the same to such Users. (b) The Concessionaire shall ensure that the advertising and marketing of the Project is carried out in a manner that is consistent with and not in derogation of or conflict with any terms or provisions of this Agreement and the Applicable Laws.
