Common use of Material Terms Clause in Contracts

Material Terms. ‌ (1) The Parties acknowledge that the terms of this Settlement Agreement set out in sections 5.1(4), 5.2(1), and 5.2(2) shall be material terms of the Settlement Agreement and the failure of the Courts to approve these terms shall give rise to a right of termination pursuant to section 15.1(1) of this Settlement Agreement.
