MATERIALS AND WORKMANSHIP. ‌ a) Unless otherwise specifically provided in this contract, all equipment, material and articles incorporated in the work covered by this contract are to be new and of the most suitable grade for the purpose intended. Unless otherwise specifically provided in this contract, reference to any equipment, material, article or patented process, by trade name, make or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition, and the contractor may, at the contractor’s option, use any equipment, material, article, or process which, in the judgment of the contracting officer is equal to that named. The contractor shall furnish to the contracting officer for approval the name of the manufacturer, the model number and other identifying data and information respecting the performance, capacity, nature and rating of the machinery and mechanical and other equipment which the contractor contemplates incorporating in the work. When required by this contract or when called for by the contracting officer, the contractor shall furnish the contracting officer for approval, full information concerning the material or articles which the contractor contemplates incorporating the work. When so directed, samples shall be submitted for approval at the contractor's expense, with all shipping charges prepaid. Machinery, equipment, material and articles installed are used without required approval shall be at the risk of subsequent rejection. b) Contractor shall not incorporate in the work any salvaged material except upon prior written approval of the contracting officer. If salvage material is accumulated during construction or installation, contractor shall adequately store and safeguard the same and shall not remove such material from the premises or site of the work without prior written consent of the contracting officer. Contractor c) Contractor warrants that no materials imported or produced with Economic Cooperation Act or Mutual Security Act funds in the country where the work is located will be used or incorporated in the construction work. d) All work under this contract shall be performed in a skillful and workmanlike manner. The contracting officer may, in writing, require the contractor to remove from the work any employee the contracting officer deems incompetent, careless, undesirable for security reasons, or otherwise objectionable. e) The contractor has sole responsibility for all such material and workmanship to include the restoration of any damaged work. The Exchange does not waive the right to require the fulfillment of all of the terms of the contract. Risk of loss shall be borne by the contractor until such time as the project is accepted by the Exchange.

When required by this contract the Contract or when called for by the contracting officerOwner or Architect/Engineer, the contractor Contractor shall furnish the contracting officer Architect/Engineer, for approval, full information concerning the material or articles which the contractor Contractor contemplates incorporating into the workWork. When so directeddirected by Owner or Architect/Engineer, samples shall be submitted for approval at the contractor's Contractor’s expense, with all shipping charges prepaid. Architect/Engineer shall not incorporate call for lead based paint or asbestos containing materials to be used in connection with the work any salvaged material except upon prior written approval of Project. No lead based paint and no materials containing asbestos shall be incorporated into the contracting officer. Neither custom nor usage of trade shall require Owner to accept materials or workmanship not in strict and complete compliance with the Contract Documents. F Unless otherwise provided in the Contract Documents, the Contractor shall provide and pay for all such material labor, materials, equipment, tools, construction equipment and workmanship to include the restoration of any damaged work. The Exchange does not waive the right to require the fulfillment of all machinery, water, electricity and other utilities, transportation, and other facilities and services necessary for proper execution and completion of the terms of Work, whether temporary or permanent and whether or not incorporated or to be incorporated into the contract.
