Materials Incorporated in Project Clause Samples

The 'Materials Incorporated in Project' clause defines which materials, components, or products are to be physically included in the construction or completion of a project. It typically specifies that only approved, conforming, and sometimes owner-furnished materials may be used, and may require documentation or inspection to verify compliance. This clause ensures that all materials used meet the project's quality and specification standards, thereby reducing the risk of defects and disputes over what was actually incorporated into the finished work.
Materials Incorporated in Project. The materials to be incorporated in the Project at any time during the Term shall, upon purchase of same and at all times thereafter during the Term, constitute the property of Tenant, and upon construction of the Project or the incorporation of such materials therein, title thereto shall vest in Tenant. Nothing in this Section shall limit the FCRHA’s vesting of all right, title, and interest in such materials located on the Premises at the expiration or earlier termination of the Term.
