Common use of Maximum number of Loans Clause in Contracts

Maximum number of Loans. (a) A Borrower may not deliver a Utilisation Request if as a result of the proposed Utilisation: (i) more than 14 Facility A Loans would be outstanding; or (ii) more than 6 Facility B Loans would be outstanding. (b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, more than 6 Term Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.

(b) A Borrower may not request that a Term Loan be divided if, if as a result of the proposed division, Loan more than 6 Term 15 Loans would be outstandingoutstanding under the Revolving Facility. (cb) Any Separate Loan made by a single Lender under Clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.44.3.

(a) A Borrower may not deliver a Utilisation Request if as a result of the proposed Utilisation: (i) more than 14 two (2) Term Loans would be outstanding; (ii) more than ten (10) Acquisition Revolving Facility A Loans would be outstanding; or (iiiii) more than 6 ten (10) General Revolving Facility B Loans would be outstanding. (b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, more than 6 Term Loans would be outstanding. (c) Any Loan made by a single Lender under Clause clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4clause 4.5.

Maximum number of Loans. (a) A Borrower may not deliver a Utilisation Request if as a result of the proposed Utilisation: (i) eight or more than 14 Facility A Loans would be outstanding; or (ii) ten or more than 6 Facility B Loans would be outstanding. (b) A Borrower may not request that a Term Facility A Loan be divided if, as a result of the proposed division, eight or more than 6 Term Facility A Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 7.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.

(a) A Borrower may not deliver a Utilisation Request if as a result of the proposed Utilisation: (i) 16 or more than 14 Facility A Term Loans would be outstanding; oror Table of Contents (ii) 16 or more than 6 Revolving Facility B Loans would be outstanding. (b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, 16 or more than 6 Term Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 9.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.

(a) A Borrower may not deliver a Utilisation Request if if, as a result of the proposed Utilisation: (i) more than 14 two Facility A Loans would be outstanding; or (ii) more than 6 five Facility B Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.

(b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, more than 6 Term Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 11.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.

(c) Any Loan made by a single Lender under Clause 6.2 6.3 (Unavailability Change of a currency) shall not be taken into account in this Clause 4.44.5.

(a) A Borrower (or the Company on its behalf) may not deliver a Utilisation Request if as a result of the proposed UtilisationLoan: (i) more than 14 10 Revolving Facility A Loans would be outstanding; or (ii) more than 6 5 Uncommitted Accordion Facility B Loans would be outstanding. (b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, more than 6 Term Loans would be outstandingNot used. (c) Any Loan made by a single Lender under Clause clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause clause 4.4.

(b) A Borrower may not request that a Term Loan be divided if, as a result of the proposed division, more than 6 Term Loans would be outstanding. (c) Any Loan made by a single Lender under Clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.4.
