Maximum Number of Warrant Shares. Notwithstanding anything herein to the contrary, the maximum number of Warrant Shares issuable under this Warrant (including, but not limited to, alternative cashless exercise pursuant to Section 2(c)(ii)) shall not exceed [____]3 and the maximum number of Warrant Shares issuable under this Warrant and all other Warrants issued by the Company pursuant to the Registration Statements (including, but not limited to, alternative cashless exercise pursuant to Section 2(c)(ii) of this Warrant and other Warrants) shall not exceed 75,000,000.
Maximum Number of Warrant Shares. Notwithstanding anything to the contrary herein, in no event shall the Company take any action which would result in the number of shares of Common Stock for which this Warrant, together with all other Warrants issued pursuant to the Agreement, is exercisable exceeding 307,108, such number being subject to subsequent adjustment pursuant to and in accordance with Section 6(a) above, without the Company’s first having received such approval from its shareholders or other Persons as may be required by the regulations of the Principal Market or any other applicable law or regulation.
