Common use of Maximum Payable Clause in Contracts

Maximum Payable. Despite any other provision of this Agreement, the maximum Milestone 3 Consideration payable is: (a) If the Buyer elects to provide the Milestone 3 Consideration by way of cash, XXXXX; or (b) If the Buyer elects to provide the Milestone 3 Consideration by way of shares, the amount of Novogen Shares equal to XXXX determined by reference to the value of the Capital Raising Shares as at the time of issue to the Seller Nominees.
