MEANS AND METHODS OF THE WORK. 37.1. Unless otherwise expressly provided in the Contract Drawings, Specifications, and Addenda, the Means and Methods of the Work shall be such as the Contractor may choose; subject, however, to the Engineer’s or Project Manger’s right to reject the Means and Methods of the Work proposed by the Contractor which in the opinion of the Engineer or Project Manager: 37.1.1. Will constitute or create a hazard to the Work, or to persons or property; or 37.1.2. Will not produce finished Work in accordance with the terms of the Contract; or 37.1.3. Will be detrimental to the overall progress of the Project. 37.2. The Engineer’s or Project Manager’s approval of the Contractor’s Means and Methods of the Work, or his/her failure to exercise his/her right to reject such means or methods, shall not relieve the Contractor of its obligation to complete the Work as provided in this Contract; nor shall the exercise of such right to reject create a cause of action for damages.
