Common use of Measurement Accuracy Verification Clause in Contracts

Measurement Accuracy Verification. (a) Each Party shall verify the accuracy of all Measurement Facilities owned by such Party at intervals based upon the following schedule: (i) semi-annually for Gas Measurement Facilities metering less than one thousand (1,000) Mcf per Day; (ii) quarterly for Gas Measurement Facilities metering between one thousand (1,000) and five thousand (5,000) Mcf per Day; (iii) monthly for Gas Measurement Facilities metering more than five thousand (5,000) Mcf per Day; and (iv) quarterly for Liquid Hydrocarbons Measurement Facilities. Neither Party shall be required to cause adjustment or calibration of such equipment more frequently than once per Month, unless a special test is requested pursuant to Section 11.7. (b) If, during any test of the Measuring Facilities, an adjustment or calibration error is found which results in an incremental adjustment to the calculated flow rate through each meter run in excess of one percent (1%) of the adjusted flow rate (whether positive or negative and using the adjusted flow rate as the percent error equation denominator), then any previous recordings of such equipment shall be corrected to zero error for any period during which the error existed (and which is either known definitely or agreed to by the Parties) and the total flow for the period redetermined in accordance with the provisions of Section 11.8. If the period of error condition cannot be determined or agreed upon between the Parties, such correction shall be made over a period extending over the last one half of the time elapsed since the date of the prior test revealing the one percent (1%) error. (c) If, during any test of any Measurement Facilities, an adjustment or calibration error is found which results in an incremental adjustment to the calculated hourly flow rate which does not exceed one percent (1%) of the adjusted flow rate, all prior recordings and electronic flow computer data shall be considered to be accurate for quantity determination purpose.

Measurement Accuracy Verification. (a) Each Party Gatherer shall verify calibrate meters as often as required, as determined by Gatherer in accordance with standard industry practices to reasonably assure accurate measurement, but at least twice per year. Calibrations of meters will be made in the accuracy presence of all Measurement Facilities owned by such Party representatives of Producer, if Producer chooses to be represented. Orifice plate and tube inspection will be made at intervals based upon each meter calibration unless a facility shut-down is required, in which case the following schedule: (i) semi-annually for Gas Measurement Facilities metering less than one thousand (1,000) Mcf per Day; (ii) quarterly for Gas Measurement Facilities metering between one thousand (1,000) and five thousand (5,000) Mcf per Day; (iii) monthly for Gas Measurement Facilities metering more than five thousand (5,000) Mcf per Day; and (iv) quarterly for Liquid Hydrocarbons Measurement Facilities. Neither Party approval of both Parties shall be required to cause adjustment or calibration of such equipment more frequently than once per Month, unless a special test is requested pursuant to Section 11.7required. (b) If, during any test of the Measuring Facilities, an adjustment or calibration error is found which results in an incremental adjustment to the calculated flow rate through each meter run in excess of one two percent (12%) of the adjusted flow rate (whether positive or negative and using the adjusted flow rate as the percent error equation denominator), then any previous recordings of such equipment shall be corrected to zero error for any period during which the error existed (and which is either known definitely or agreed to by the PartiesProducer and Gatherer) and the total flow for the period redetermined in accordance with the provisions of Section 11.811.7. If, during any test of the measuring equipment, an adjustment or calibration error is found Gas Processing Agreement dated [______________] Between Alpine High Processing LP (Processor) and [_____________] (Producer) that results in (i) an incremental adjustment to the calculated flow rate through each meter run in excess of two percent (2%) of the adjusted flow rate (whether positive or negative and using the adjusted flow rate as the percent error equation denominator) and (ii) a quantity error greater than two hundred fifty (250) Mcf per Month (“Material Measurement Error”), then any previous recordings of such equipment shall be corrected to zero error for any period during which the error existed (and which is either known definitely or agreed to by the Parties) and the total flow for the such period redetermined shall be determined in accordance with the provisions of Section 11.85.6. If the period of error condition cannot be determined or agreed upon between the Parties, such correction shall be made over for a period extending over the last one half (1/2) of the time elapsed since the date of the prior test revealing the one percent (1%) errorlast test. (c) If, during any test of any Measurement Facilities, an adjustment or calibration error is found which results in an incremental adjustment to the calculated hourly flow rate which does not exceed one percent (1%) of the adjusted flow rate, all prior recordings and electronic flow computer data shall be considered to be accurate for quantity determination purpose.

Measurement Accuracy Verification. (a) Each Party shall verify the accuracy of all Measurement Facilities owned by such Party transmitters, flow computers, and other equipment used in the measurement of the Gas hereunder at intervals not to exceed one hundred eighty (180) Days and cause such equipment to be adjusted or calibrated as necessary. Testing frequency will be based upon the following schedule: each well or station’s flow rate (i) Mcf/Day). Any flow rate greater than or equal to 5,000 Mcf/Day shall be tested monthly. Any flow rate that is greater than or equal to 1,000 Mcf/Day, but less than 5,000 Mcf/Day, shall be tested semi-annually for Gas Measurement Facilities metering less than one thousand (1,000) Mcf per Day; (ii) quarterly for Gas Measurement Facilities metering between one thousand (1,000) and five thousand (5,000) Mcf per Day; (iii) monthly for Gas Measurement Facilities metering more than five thousand (5,000) Mcf per Day; and (iv) quarterly for Liquid Hydrocarbons Measurement Facilitiesannually. Neither Party shall be required to cause adjustment or calibration of such equipment more frequently than once per every Month, unless a special test is requested pursuant to Section 11.7. (b) 13.5 of this Agreement. If, during any test of the Measuring Facilitiesupon test, an (i) no adjustment or calibration error is found which that results in an incremental adjustment to the calculated flow rate through each meter run in excess of one percent (1%) of the adjusted flow rate (whether positive or negative and using the adjusted flow rate as the percent error equation denominator) or (ii) any quantity error is not greater than two hundred fifty (250) Mcf per Month, then any previous recordings of such equipment shall be considered accurate in computing deliveries but such equipment shall be adjusted or calibrated at once. Any flow rate at a Delivery Point that is: (x) greater than 1,000 Mcf/Day shall be tested Monthly, (y) between 101 and 1,000 Mcf/Day shall be tested quarterly, and (z) less than 100 Mcf/Day shall be tested semi-annually for Gas Measurement Facilities metering less than one thousand (1,000) Mcf per Day; (ii) quarterly for Gas Measurement Facilities metering between one thousand (1,000) and five thousand (5,000) Mcf per Day; (iii) monthly for Gas Measurement Facilities metering more than five thousand (5,000) Mcf per Day; and (iv) quarterly for Liquid Hydrocarbons Measurement Facilitiesannually.
