Common use of Method of Exercise Clause in Contracts

Method of Exercise. While this Warrant remains outstanding and exercisable in accordance with Section 3 above, the Holder may exercise, in whole or in part, the purchase rights evidenced hereby. Such exercise shall be effected by: (a) the surrender of the Warrant, together with a duly executed copy of the form of Notice of Election attached hereto, to the Secretary of the Company at its principal offices; and (b) the payment to the Company of an amount equal to the aggregate Exercise Price for the number of Shares being purchased.

Such exercise shall be effected by: (a) 4.1 the surrender of the Warrant, together with a duly executed copy of the form of Notice of Election Exercise attached hereto, to the Secretary of the Company at its principal offices; and (b) 4.2 the payment to the Company of an amount equal to the aggregate Exercise Price for the number of Shares being purchased.

Method of Exercise. While this Warrant remains outstanding and exercisable in accordance with Section 3 above, the Holder may exercise, in whole or in part, but in increments of no less than 10,000 shares, the purchase rights evidenced hereby. Such exercise shall be effected by: (a) the surrender by tender of the Warrant, together with a duly executed copy of the form of Exercise Notice of Election attached hereto, to the Secretary of the Company at its principal offices; and (b) , and the payment to the Company of an amount equal to the aggregate Exercise Price purchase price for the number of Shares being purchasedpurchased unless done by cashless exercise.
