Middle and High Schools. The principal must notify the superintendent or designee of all violations of this policy and recommend appropriate consequences. In making a recommendation, the principal must provide an assessment of whether any availa- ble services, such as school counseling, an al- ternative school, or substance abuse programs would assist the student and whether any ser- vices should be part of the consequences. Middle and High Schools. Certain extracurricular activities of a specialized nature, intensive demand, or long duration cannot be satisfactorily distributed in a routine manner. For these responsibilities the District shall pay an additional stipend, beyond the regular contract salary. Bargaining unit members assigned to these activities shall be entitled to extra remuneration only if they have discharged fully the responsibilities of all teachers as defined in the normal teaching day. Extra pay for extra services shall be limited to those activities which involve teaching and/or supervision of pupils. Exceptions to this policy shall be the assignment of department heads and directors of athletics which are administrative in nature. No bargaining unit member shall be assigned more than three remunerative extracurricular responsibilities during the school year. Remunerative extracurricular assignments shall be made annually by the governing board upon the recommendation of the building principal and district office administrative staff. The following responsibilities (Page 34) are recognized as extra-pay assignments and shall entitle the bargaining unit member so assigned to extra remuneration to be paid at the rate established.
Middle and High Schools. 11.2.1 High School Class Size Limits With exceptions noted for music ensembles and supervisories, high school classes shall have a limit of 28 students per class. Physical Education classes shall have a limit of 31 students per class. Driver Education - to be determined by State Education Department time requirements, facilities, the scheduling of classes, simulators and car groups. 11.2.2 Middle School Class Size Limits Team populations will be based on average class size of 25 students. All middle school classes shall have a limit of 28 students per class. An overage occurs when class size reaches 29 or more students except for physical education. Physical Education class limit is 31 students and an overage occurs when class size reaches 32 or more students. If chorus, orchestra, or band is ever included within the regular school day (excluding Alpha block) for whole-group ensembles no overage will be paid for that class. Unified Arts classes will average 1/5 of a team population. Physical Education/Health/Music classes will average 1/4 of a team population. 11.2.3 Calculation of Overages Team populations are based on an average class size of 24 students for Health/Music/PE. One quarter (1/4) of the team total derives the maximum students per class. Example: “six teams” times 24 students equal 144 total times 1/4 which equals 36 students. If any class exceeds 36 students, an overage exists per Section 11.2.2. Payment for each Health, Music, or PE class that exceeds 36 students shall be $500.00 per semester.

  • MIDDLE SCHOOLS 1. Where there are no negotiated provisions concerning the implementation or operation of a middle school program, this article shall govern the implementation or operation of a middle school program in a school district. 2. Should the employer seek to establish a middle school program in one or more schools in a district, the employer and the local shall meet, no later than ten (10) working days from a decision of the employer to implement a middle school program, in order to negotiate any alternate or additional provisions to the Collective Agreement which are necessary to accommodate the intended middle school program. 3. In the absence of any other agreement with respect to the instructional day and preparation time, the provisions of the Collective Agreement with regard to secondary schools shall apply to middle schools. 4. If the employer and the local are unable to agree on what, if any, alternate or additional provisions of the collective agreement are necessary to accommodate the intended middle school program(s), either party may refer the matter(s) in dispute to expedited arbitration for final and binding resolution pursuant to Article D.5.5 below. a. The jurisdiction of the arbitrator shall be limited to the determination of alternate or additional provisions necessary to accommodate the intended middle school program(s). b. In the event the arbitration is not concluded prior to the implementation of the middle school program, the arbitrator will have remedial authority to make appropriate retroactive modifications and adjustments to the agreement. c. The arbitration shall convene within thirty (30) working days of referral to arbitration in accordance with the following: i. Within ten (10) working days of the matter being referred to arbitration, the parties shall identify all issues in dispute; ii. Within a further five (5) working days, there shall be a complete disclosure of particulars and documents; iii. Within a further five (5) working days, the parties shall exchange initial written submissions; iv. The hearing shall commence within a further ten (10) working days; and v. The arbitrator shall render a final and binding decision within fifteen (15) working days of the arbitration concluding. 6. Where a middle school program has been established on or prior to ratification of the 2006-2011 Provincial Collective Agreement, the existing provisions shall be retained unless the parties mutually agree that they should be amended.

Sept. 1, 2023, Section 2275.0103, pursuant to House Bill 4595, Acts 2023, 88th Leg., R.S.), or (2) headquartered in any of those countries.
